Provider information
1. Purpose and acceptance
1.1 Purpose
These Terms and Conditions (the “Terms”) govern access to and use of the websites inbestplanners.com and inbestplanners.es and of the associated services (the “Service” or the “Platform”), provided by Mr Juan José Cirera Ortiz (tax ID 77843834N), who trades under the name InbestPlanners (“InbestPlanners”, “we”, “us” or the “Provider”). His contact details appear at the top of these Terms.
1.2 Acceptance
By accessing, registering for or using InbestPlanners, you:
- Declare that you have read and understood these Terms.
- Agree to be legally bound by them.
- Confirm that you are of legal age (18 or over).
- Confirm that you have the legal capacity to enter into contracts.
If you do not agree with these Terms, do not use the Platform.
1.3 Related documents
In addition to these Terms:
- The Pricing page describes what each Plan includes; the version shown when you subscribe forms part of the contract (clause 6.1).
- The Privacy Policy tells you how we process your personal data. It is not a contract you accept but the information the law requires us to give you.
- The Cookie Policy tells you which cookies we use and how to manage your consent.
- The Conflicts of Interest Policy and the Methodology explain how Signals are produced and how conflicts of interest are managed.

3. Description of the Service
3.1 What InbestPlanners offers
InbestPlanners is an automated stock market analysis tool that offers, to the extent each Plan allows as described in clause 6.1:
- Technical analysis of stocks (RSI, MACD, ADX, Bollinger Bands, trends, momentum).
- Fundamental analysis (ROE, P/E, debt ratios, cash flow, earnings stability).
- Four-pillar scoring: Quality Score, Value Score, Dividend Score, and Technical Score, combined into a General Score.
- Automated signals: Bounce (mean reversion, short term) and Impulse (trend-following, medium term), based on historical statistical patterns.
- 360 Analysis: full reports on each stock (every stock on the Professional Plan; the companies drawn each day on the Starter Plan and for Visitors).
- Rankings: 360, quality, value, technical and dividends.
- Portfolio tracking, alerts, favourites lists, a stock screener and a comparison tool.
- Conviction Scores, calculated by a machine-learning model from historical technical data.
- The League, a signal-picking competition (clause 3.5).
3.2 Coverage
The Platform analyses approximately 1,300 stocks from 12 markets:
- United States: S&P 500, NASDAQ, Dow Jones, Russell 1000
- Eurozone: DAX 40, CAC 40, Euro Stoxx 50, IBEX 35
- Non-Eurozone Europe: FTSE 100, SMI, OMX Stockholm 30, OMX Copenhagen 25
3.3 How it works
All analyses, signals, and rankings are generated by automated algorithms that process publicly available market data. The Content displayed is identical for everyone with the same level of access. You can set preferences such as markets, alerts or favourites lists, but the analysis algorithms are the same for everyone. We do NOT tailor the Content to your financial situation, risk tolerance or investment history.
The company descriptions shown with the 360 Analysis are written automatically, with the help of artificial intelligence, from public information supplied by the market-data provider. They may contain inaccuracies and are not part of the Signals.
3.4 Communications included
As part of the Service, the Plans include a weekly Signals digest by email and, if you take part in the League and hold a position in it, its weekly ranking. Both are on by default and you can unsubscribe from each with one click using the link in the email itself. We also send the emails needed to manage the contract and the Account (sign-up, billing, security and contractual notices), which cannot be switched off while the Account exists.
3.5 League
Users may take part voluntarily in the League, a ranking that scores the Signals each participant selects. Once you activate it, your alias, the Signals you select and their results are shown in the League to other users and to Visitors (to Visitors without naming your open positions). A participant is ranked once five of their Signals have resolved. The League includes automated accounts run by the Provider, labelled as simulated, which are not users. Taking part involves no money, and League results do not indicate what you would earn by investing. You can stop taking part at any time from the League settings.
3.6 Features being piloted
We may offer features in a pilot phase, labelled as such on the Platform, such as intraday tracking of Signals on the Plans (whether a new Signal’s entry order has filled and how an active Signal moves during the session). Their data is provisional and may be delayed, incomplete or missing; the official record of each Signal is the one published after the market close. These features may be changed or withdrawn, and withdrawing them does not reduce the content of the Plan described in clause 6.1.
4. Nature of the Service: not financial advice
4.1 Fundamental declaration
InbestPlanners is not a financial, investment, tax or legal advisory service. Signals are non-personalised investment recommendations: they do not take your personal situation into account and do not constitute investment advice within the meaning of Directive 2014/65/EU (MiFID II) or equivalent national legislation.
4.2 What InbestPlanners is not
InbestPlanners is NOT:
- A registered or regulated financial advisor.
- An investment firm or a tied agent.
- An entity supervised by the SEC, the FCA, the CNMV, BaFin, the AMF or any other financial regulator.
- A portfolio or wealth manager.
- A personalised recommendation service.
4.3 No personalisation
InbestPlanners Content:
- Is generated by automated algorithms.
- Is identical for everyone with the same level of access.
- Does NOT take into account your personal financial situation.
- Does NOT take into account your investment objectives.
- Does NOT take into account your risk tolerance.
- Does NOT take into account your investment experience.
4.4 Nature of the Content
Signals, rankings and scores are non-personalised investment recommendations within the meaning of art. 3(1)(35) of Regulation (EU) 596/2014 on market abuse, and are published with the disclosures its art. 20 requires. The rest of the Content (analyses, metrics and articles) is general market information. All Content, Signals included:
- Is the result of statistical processing of public data.
- Is NOT investment advice: it is not produced by reference to your personal circumstances, nor presented as suitable for you.
- Is NOT an offer of financial instruments.
- Is NOT a substitute for professional advice.
4.5 Your responsibility
Before making any investment decision, you should:
- Do your own research and analysis.
- Consult qualified professional financial advisers where you need to.
- Assess whether the investment suits your personal situation.
- Consider your ability to bear losses.
4.6 Regulatory classification
Under MiFID II (Directive 2014/65/EU), investment advice is a personalised recommendation based on each client’s circumstances. The Provider does not assess your financial situation, investment objectives, risk tolerance or knowledge and experience (there is no suitability or appropriateness assessment).
Signals, rankings and scores are non-personalised investment recommendations (clause 4.4). The rest of the Content is general information about statistical patterns observed in publicly available market data, comparable to what financial data terminals, charting tools or stock screeners provide.
The Provider is not authorised or registered as an investment firm or as a tied agent with the CNMV (Spain), the SEC (US), the FCA (UK) or any equivalent financial supervisory authority. As it provides no investment services and no personalised advice, it understands that no such authorisation is required.
Signals are generated by automated algorithms, without human editorial intervention. The natural person responsible for their production may hold positions in the securities analysed. That circumstance, and the mechanism applied to neutralise it, are disclosed in the Conflicts of Interest Policy, freely accessible from the footer of this site.
4.7 Authorship of the recommendations
The recommendations published are produced by InbestPlanners. The natural person responsible for producing them, for the purposes of art. 2(1)(a) of Delegated Regulation (EU) 2016/958, is Mr Juan José Cirera Ortiz, sole owner and founder, whose identifying details appear at the top of these Terms.
By using the Service you acknowledge that every published recommendation comes from InbestPlanners, in the person of its responsible individual, wherever on the site it is displayed and whether or not it appears alongside another user’s profile. Where a recommendation appears on a League participant’s public profile, that participant has only selected it: the recommendation is not theirs.
5. Registration and Account
5.1 Requirements
To create an Account you must:
- Be of legal age (18 or over).
- Provide a valid email address.
- Create a secure password, or sign in with your Google account.
- Accept these Terms and have read the Privacy Policy, which tells you how we process your data.
5.2 Accuracy
You warrant that the information you provide is true, complete and up to date. We may suspend Accounts with false information under clause 17.2.
5.3 Account security
You are responsible for:
- Keeping your credentials confidential.
- Activity carried out from your Account with your credentials.
- Telling us immediately of any unauthorised access at admin@inbestplanners.com.
5.3.1 Account protection
For security, after 5 failed sign-in attempts with the same email address from the same IP address, that access is temporarily locked: 5 minutes the first time, and twice as long with each new lock on the same day, up to a maximum of 24 hours.
If you sign in with a password, you can turn on two-factor authentication (2FA) via TOTP (e.g. Google Authenticator): a one-time code is then required in addition to your password. We recommend turning it on. 2FA is available only for Accounts with a password: Accounts that sign in with Google are protected by the security of your Google account, and an Account with a password and 2FA turned on cannot sign in with the Google button.
5.4 One Account per person
You may not:
- Create more than one Account.
- Share your credentials with third parties.
- Transfer or sell your Account.
5.5 Sign-ups not completed
There is no free plan with an Account: free access is Visitor access, without registering. If you create an Account and neither complete payment nor start the Trial, the Account and its data are deleted automatically once 48 hours have passed since it was created.
6. Plans and prices
6.1 Available plans
| Plan | Price | What it includes (summary) |
|---|---|---|
| Visitor (no Account) | Free | No registration. Four new Signals a day, one of each method (Bounce and Impulse) in Europe and one in the US, drawn at random, except on a day when a market has no new Signals of a method; active Signals with their entry price, last close and return; the full history of closed Signals; those same companies, and no others, in the rankings and with their full 360 Analysis; the stock screener with limited results; the blog and articles. |
| Starter | €14.99 per month; in the United Kingdom, £12.99 per month; in the Americas, US$16.99 per month, and in Brazil, R$89.90 per month (taxes included) | All Signals with all their data (entry, target, stop and Conviction Score); exit alerts; full rankings and scores; screener with basic filters (3 saved searches); up to 10 stocks in favourites; portfolio of up to 5 positions; comparison of 2 stocks; taking part in the League; full 360 Analysis of the companies drawn each day. |
| Professional | €29.99 per month; in the United Kingdom, £25.99 per month; in the Americas, US$33.99 per month, and in Brazil, R$178.90 per month (taxes included) | Everything in Starter, plus: full 360 Analysis and Signal history of every stock; unlimited alerts (7 types, push notifications included); advanced screener filters and unlimited saved searches; unlimited favourites and portfolio; comparison of up to 5 stocks; investor patterns in the League. |
This table is a summary. The full detail of each Plan is on the Pricing page; the version shown when you subscribe forms part of the contract and can change only under clause 16.
6.2 Final price and taxes
The advertised price is the final price: prices include all taxes (VAT included) and no other charge is added. The tax breakdown is shown before you confirm payment and on your invoice.
6.3 Currency
Plans are charged in euros (EUR), except from the United Kingdom (with the Channel Islands, the Isle of Man and Gibraltar), in pounds sterling (GBP), and from the Americas: from Brazil, in Brazilian reals (BRL), and from the rest of the continent, in US dollars (USD), at the fixed amounts in the table of clause 6.1, not by a conversion. The currency depends on the country you subscribe from, which is inferred from your IP address; it is shown on the Pricing page and on the payment screen before you confirm, and the subscription is charged in it for as long as it lasts. If your card is in another currency, the amount charged to it will depend on your bank’s exchange rate and fees.
6.4 Changing Plan
Upgrades: take effect immediately. The price difference for the rest of the current period is calculated pro rata and invoiced and charged at that moment; the new Plan starts once that charge goes through.
Downgrades: take effect at the start of the next billing period; until then you keep the features of your current Plan.
Plan changes are made only on the Platform (the Pricing page or Settings > Subscription). The Stripe portal is for managing your payment method, viewing your invoices and cancelling, not for changing Plan.
7. Free trial
7.1 Trial conditions
We offer a 7-day free trial (168 hours from activation) of the Starter and Professional Plans, subject to:
- One trial per person. If you have already had a trial with that email address or that card, no further trial is granted and, should one start, it is cancelled with no charge. To check this we keep a register holding a keyed hash (a pseudonym) of your email address and of your card fingerprint, as described in the Privacy Policy.
- A valid payment method must be registered.
- Full access to the features of the chosen Plan.
7.2 End of the trial
- If you cancel before the end of day 7: no charge is made and you keep access until the trial ends (clause 10.3).
- If you do not cancel: when the trial ends the Plan price is charged automatically, as notified to you under clause 8.6. If that first charge does not go through, you will not have access to the Plan while the charge is retried (clause 8.5); access starts once the payment goes through.
7.3 Right of withdrawal during the trial
The free trial is independent of the right of withdrawal the law gives you as a consumer, described in clause 9. During the trial you pay nothing, so ending the Service, by whatever means, gives rise to no amount payable by or to either party.
8. Payments and billing
8.1 Payment processor
Payments are processed by Stripe Payments Europe, Ltd. (Ireland). Stripe processes your payment data under its own privacy policy. Our Privacy Policy explains what data we share with Stripe.
8.2 Security
We do not store your full card details: they are handled exclusively by Stripe under the PCI-DSS standard.
8.3 Billing cycle
Subscriptions are billed monthly, on the same date each month counted from the start date.
8.4 Duration and automatic renewal
The contract has no fixed end date and renews automatically for monthly periods until you cancel it. You can turn renewal off at any time from your Account (clause 10.1).
8.5 Failed payments
If a payment does not go through:
- Stripe retries the charge for 7 days.
- If you have already paid any instalment of this Subscription, you keep access to your Plan while the charge is retried. If you have not paid any yet (for example, when the first charge after the trial fails), the Account has Visitor access only until the payment goes through.
- If the payment never goes through, the Subscription is cancelled and the Account reverts to Visitor access.
8.6 Notice at sign-up
In accordance with Article 97.1.p) of Royal Legislative Decree 1/2007 (TRLGDCU), when you subscribe we will tell you by email, together with the welcome email, the deadline for giving notice of non-renewal, the amount that will be charged and the consequences of not cancelling, with a direct cancellation link.
That communication is sent once, on the day you sign up, including when the Subscription starts with a Trial. No later reminders and no notice before each renewal are sent: renewal is automatic under clause 8.4, the date and the amount are stated in that communication and in your Account, and you can turn renewal off at any time from your Account.
The deadline for giving notice of non-renewal runs to the end of the current period: you may cancel up to that moment, with effect at the end of the period, keeping access until then.
9. Right of withdrawal (consumers)
9.1 Right and period
If you contract as a consumer, you have fourteen (14) calendar days to withdraw from the contract without giving any reason and without penalty. The period starts on the day after the contract is concluded and ends at 23:59 (Spanish peninsular time) on the fourteenth calendar day.
9.2 How to exercise it
You may withdraw by any unequivocal statement addressed to the Provider, in particular:
- using the withdrawal form, which reproduces the statutory model; or
- by email to admin@inbestplanners.com.
You do not have to use the form or give a reason. We will acknowledge receipt without delay on a durable medium (e.g. by email).
9.3 Effects and refund
We will refund all payments received within fourteen (14) calendar days of learning of your decision, using the same means of payment you used and at no cost to you. If you expressly requested immediate commencement of the service under clause 9.4, you will pay only an amount proportional to the service provided up to the time you told us of your withdrawal, calculated on the total price of the contracted period. If at that time you have paid nothing, withdrawal gives rise to no payment or refund.
9.4 Express request for immediate commencement
By subscribing, you state: “I expressly request that provision of the service begin immediately, within my fourteen (14) calendar day withdrawal period under clause 9.1, without waiting for that period to expire”.
And you declare that you know that, once the Provider has fully performed the contract, you will have lost your right of withdrawal.
The service consists of continuous access to a platform whose content is updated every market session, so its usefulness depends on being available from the first day. The subscription is therefore activated at the time of contracting and no deferred-start option is offered.
As long as the contract has not been fully performed, you keep your right of withdrawal: this request neither limits nor suspends it. Because the Subscription is provided in monthly periods, longer than the fourteen-day withdrawal period, full performance cannot occur within that period. Its only effects are these two:
- The service is available from the first day, without waiting fourteen days.
- If you withdraw, you will pay an amount proportional to the part of the service already provided at that time, calculated on the total price of the contracted period, in accordance with Article 108.3 of the TRLGDCU and clause 9.3. The rest is refunded to you.
The statement, its date and the version of this text under which it was made are recorded. The contract confirmation email describes the immediate commencement of the service and its financial consequence.
9.5 Withdrawal and the trial
Where the contract includes a Trial, the contract is concluded when you start it and the withdrawal period in clause 9.1 starts on the following day.
If you withdraw during the Trial, you will have paid nothing and the withdrawal gives rise to no payment or refund.
If you withdraw after the first charge and within the period, the amount charged is refunded. Where you requested immediate commencement under clause 9.4, only the proportional part of the billing period elapsed between the charge and your communication is deducted, calculated on the price of that period.
10. Cancellation and refunds
10.1 How to cancel
You can cancel your Subscription at any time:
- From Settings > Subscription > Cancel.
- From the Stripe portal, reached from Settings > Subscription.
10.2 Effect of cancellation
- You keep access until the end of the period already paid for.
- There is no further renewal.
- When that period ends, your Account reverts to Visitor access.
10.3 Refund policy
Cancelling does not give rise to a refund of the current period: you keep access until the end of the period already paid for and no further charges are made. This does not affect the right of withdrawal (clause 9), your rights if the Service is not in conformity (clause 15.3) or the refunds provided for in clauses 10.4, 16.1, 17.3 and 21.4.
Trial
If you cancel during the trial, you keep access to the Plan until the trial ends and no charge is made. If you cancel in the short interval between the end of the trial and the first charge, the Subscription ends at that moment and that charge is voided. If the first charge has already been made, you may exercise the right of withdrawal on the terms of clause 9.
10.4 Wrongful charges and other refunds
Duplicate or erroneous charges are always refunded, to the same means of payment.
In addition, and without prejudice to your rights for lack of conformity (clause 15.3), we will consider a refund in the case of:
- Serious technical errors attributable to us.
- Justified extraordinary circumstances.
You can request them at admin@inbestplanners.com.
10.5 Deleting your Account
If you delete your Account, the contract ends at that moment: the Subscription is cancelled immediately, you lose access to the Service and the unused part of the current period is not refunded. If you want to keep access until the end of the period already paid for, cancel the Subscription under clause 10.1 instead of deleting the Account. This does not affect the right of withdrawal in clause 9 or the rights you have as a consumer.
11. Disclaimer of liability for investments
11.1 Risk warning
Read this clause in full before using InbestPlanners.
Investing in financial markets involves a risk of loss, including the total loss of the capital invested. Past performance does not guarantee future results.
11.2 No guarantee of results
You acknowledge that:
- Signals, analyses, rankings and probabilities are statistical estimates based on historical data.
- The Conviction Score displayed is a statistical estimate based on historical patterns, not a guarantee of future results.
- The Quality Score is an automated rating, not a personalised recommendation or a guarantee of results.
- Financial markets are inherently unpredictable.
- No system can predict with certainty how markets will behave.
11.3 Your investment decisions are yours
You acknowledge that:
- YOU ALONE ARE RESPONSIBLE for your investment decisions.
- You should do your own research before investing.
- We recommend that you consult qualified professionals (financial, tax and legal advisers).
- InbestPlanners has NOT made any personalised recommendation to you.
- Any decision to buy, sell or hold securities is yours alone.
11.4 Exclusion of liability
To the maximum extent permitted by law:
The Provider and its collaborators and suppliers shall not be liable:
- For economic losses arising from your investment decisions, including trades you make based on the Content.
- For loss of profit, or of expected savings or income, arising from those decisions.
- For the consequences for your investments of errors or omissions in data or analyses, or of interruptions to the Service.
This exclusion concerns the outcome of your investments. It does not limit our liability for providing the Service as described in these Terms, nor your rights for lack of conformity (clause 15.3).
Our maximum total liability, for any reason and to the maximum extent permitted by applicable law, is limited to the total amount you paid in the 12 months before the event giving rise to the claim. This limit does not apply to liability that cannot be excluded or limited under applicable law, such as liability for intentional misconduct or gross negligence, for lack of conformity of the Service, or for breach of your data protection rights under the GDPR.
11.5 Acknowledgement of risk
By using the Service you declare that you understand InbestPlanners is an analysis tool and not a financial advisory service; that investing carries a risk of loss, including total loss of capital; and that any investment decisions you make are yours alone. This declaration does not limit the rights the law gives you as a consumer, nor any liability that cannot legally be excluded.
12. Acceptable use
12.1 Permitted uses
- Personal use, for your own analysis and information.
- Making informed decisions about your own investments.
12.2 Prohibited uses
The following are expressly prohibited:
- Redistribution: Sharing, reselling, publishing or distributing the Content.
- Scraping: Using bots, scripts or automated systems to extract data.
- Reverse engineering: Decompiling the Platform or extracting its code, models or data by technical means.
- Commercial use: Using the Content for your own commercial services without our permission.
- Multiple Accounts: Creating more than one Account or getting round the limits of your Plan.
- Interference: Attacking, overloading or interfering with the Platform.
- Illegal activity: Using the Platform for unlawful purposes.
12.3 Consequences
Breaches of this clause may lead to suspension of the Account or termination of the contract under clause 17.2, including its prior notice where applicable. A precautionary suspension does not deprive you of that procedure or of any refunds due under clause 17.3.
13. Intellectual property
13.1 Ownership
The following belong to the Provider, except market data, which belongs to its suppliers:
- The "InbestPlanners" brand and associated visual elements.
- Algorithms, formulas, and methodologies (Conviction Score, Quality Score, etc.).
- Source code, design, and Platform architecture.
- Generated Content (analyses, signals, rankings).
- Documentation and materials.
13.2 Limited licence
We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to access and view the Content according to your Plan or, if you have no Account, to Visitor access.
This licence does NOT include the right to copy, modify, distribute, sell, or create derivative works.

14.4 Exercising your rights
To exercise your rights under the GDPR, write to admin@inbestplanners.com with “Data Protection” in the subject line.
15. Availability and guarantee of conformity
15.1 Availability
We strive to keep the Service available, but do not guarantee that it will run without interruptions or errors, without prejudice to the guarantee of conformity in clause 15.3.
15.2 Third-party data
Market data comes from third-party providers that aggregate publicly available financial information. We do not guarantee its accuracy, completeness or timeliness: it may be delayed, incomplete or contain errors from the source provider.
15.3 Guarantee of conformity
The Service is provided as described in these Terms and on the Pricing page. If you contract as a consumer, you have the rights the law gives you where digital content or services are not in conformity (Articles 114 et seq. of the TRLGDCU): you can ask us to bring the Service into conformity and, if we do not do so within a reasonable time or the lack of conformity is serious, obtain a proportionate price reduction or terminate the contract. Beyond that guarantee, we do not guarantee any investment result (clause 11) or the accuracy of third-party data (clause 15.2).
16. Changes
16.1 Changes to these Terms
We may change these Terms only for a valid reason: a change in law or regulation or a decision of an authority; a change to the Service (new features, or the modification or withdrawal of features or markets, including where a data or payment provider requires it); security reasons; or correcting errors or clarifying the wording. Where the change is substantial, because it affects your rights or obligations or the content of the contracted Service (price changes are governed by clause 16.2):
- We will notify you by email, at the address of your Account, at least 15 calendar days before it takes effect. The notice states what changes and why, the date it takes effect and how to cancel before that date.
- We will publish the new version on the Platform, with its version number and date, before sending the notice.
If you do not agree with a substantial change, you may terminate the contract without penalty before it takes effect, with a refund of the proportional part of the period already paid for and not used. If, after receiving the notice, you continue to use the Service once the change takes effect, the change will apply to you.
16.2 Price changes
Price changes will be notified to you by email, at the address of your Account, at least 30 calendar days in advance. The notice states the Plan affected, the new price and the first renewal it applies to, which will always fall after that period; until then the current price is kept. If you do not agree, you may cancel before that renewal at no cost, and you will keep access until the end of the period already paid for. The new price is also published on the Platform.
17. Termination
17.1 By you
You can cancel your Subscription under clause 10 or delete your Account from Settings > Profile > Delete account. Deleting the Account ends the contract immediately, with the effects described in clause 10.5.
17.2 By us
We may suspend your access or terminate the contract if:
- You breach these Terms.
- You engage in any of the prohibited uses in clause 12.2.
- We detect fraud or abuse.
- Fees due are not paid (clause 8.5).
Except in the case of fraud, abuse or serious breach, before terminating the contract we will notify you by email, stating the reason, and give you 10 calendar days to remedy it or give us your explanation. In the case of fraud, abuse or serious breach we may suspend access immediately; we will tell you the reason and you may reply by the same means before we terminate the contract. Non-payment is governed by clause 8.5.
17.3 Effects
After termination:
- Access to the Platform is revoked.
- If termination is due to a serious breach of these Terms by you, amounts paid for the current period are not refunded. In any other case of termination by us, you are refunded the proportional part of the period paid for and not used. All of this is without prejudice to clause 9 and to your statutory rights as a consumer.
- If you delete your Account, your data is deleted immediately, with no recovery period, except for the records the Privacy Policy says are kept, among them invoices, for the period required by law, and the evidence of your consents, which stays blocked for five years solely to defend against claims. Encrypted backups may contain your data until they are replaced in their ordinary rotation, as the Privacy Policy explains, and are used for no other purpose. If the Account goes 24 months without use and without any contract in force, it is deleted with these same effects, after an email notice 30 days beforehand (Privacy Policy, section 5). In any other case, your data is kept and deleted according to the periods in the Privacy Policy.
- Clauses 11 (disclaimer of liability), 13 (intellectual property) and 20 (governing law and jurisdiction) survive termination of the contract.
18. Territorial Scope of the Service
18.1 The Service is directed mainly at consumers resident in Spain and in the other Member States of the European Union.
18.2 The Service may be contracted from any country. Anyone who accesses or contracts it from outside the European Union does so on their own initiative and is responsible for ensuring that accessing and using the Service is lawful under the laws of their country. InbestPlanners is not registered with or authorised by supervisory authorities of other countries, such as the US SEC or the UK FCA, and its content does not constitute investment advice in any jurisdiction.
18.3 Nothing on this site constitutes an offer or invitation in any jurisdiction where its distribution or use would be contrary to local law.
19. Contracting from Outside the European Union
19.1 Anyone contracting from outside the European Union does so under these same Terms, including their governing law and jurisdiction (clause 20). The price is charged in euros; any currency conversion fees your bank applies are not included.
19.2 If the laws of your country come to prevent you from using the Service, you may cancel your Subscription at any time under clause 10 and will keep access until the end of the period paid for.
20. Governing law and jurisdiction
20.1 Governing law
These Terms are governed by Spanish law.
20.2 Jurisdiction
For any dispute arising from these Terms, if you contract as a consumer the courts of your place of domicile have jurisdiction. If you do not contract as a consumer, the parties submit to the courts of Seville (Spain).
20.3 EU consumers
If you are a consumer resident in the EU, the choice of Spanish law does not deprive you of the protection afforded by the mandatory provisions of the law of your country of residence (Article 6(2) of Regulation (EC) No 593/2008, Rome I).
20.4 Complaints and alternative dispute resolution
You can send us any complaint at admin@inbestplanners.com or to our postal address (clause 22). We will reply as soon as possible and in any event within the period set by law. The Provider is not currently a member of any consumer alternative dispute resolution scheme. If you consider that we have not resolved your complaint, you may contact the accredited ADR entities and the public consumer services of your place of residence.
Complaint forms: official complaint forms of the Regional Government of Andalusia (Junta de Andalucía) are available to consumers (Decree 472/2019 of 28 May). 21. General provisions
21.1 Entire agreement

If any clause is declared void, the others shall remain in force.
21.3 No waiver
Failure to exercise a right does not mean it is waived.
